MandalaHeart Terms of Service

Effective Date: January 6, 2026

These Terms of Service (“Terms”) govern your access to and use of MandalaHeart’s services, including our websites, apps, APIs, SMS, email notifications, widgets, advertisements, and any other services that link to these Terms (collectively, the “Services”), and any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Services (collectively, “Content”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Basic Terms

You are responsible for your use of the Services, for any Content you post, and for any consequences thereof. Most Content you submit is public by default and can be viewed by other users and third-party services. Only submit Content you are comfortable sharing.

You may use the Services only if you are at least 18 years old, and can form a binding contract with MandalaHeart. MandalaHeart may change, suspend, or discontinue the Services (or features thereof) at any time without notice. The Services may include advertisements; by using the Services, you consent to these advertisements.

2. Eligibility

You are at least 18 years old.
You have never been convicted of a felony or a sexual offense, and are not required to register as a sex offender.
You have not previously been suspended or removed from MandalaHeart.
You are using the Services for personal purposes, not in competition with MandalaHeart.
You are not located in, under the control of, or a national of any jurisdiction restricted by law.

3. Privacy

Your information is governed by our Privacy Policy, which describes how we collect, use, and store your information. By using the Services, you consent to the collection, storage, and transfer of your information, including outside of your country (e.g., Nepal, the United States, or other jurisdictions).

Some communications from MandalaHeart, such as service announcements, are considered part of the Services and cannot be opted out of.

4. Account Security

You are responsible for safeguarding your account password. MandalaHeart cannot and will not be liable for any loss or damage arising from your failure to maintain account security.

5. Content on the Services

All Content, whether public or private, is the responsibility of the user who created it. MandalaHeart does not endorse or verify Content, and is not responsible for its accuracy, completeness, or legality. You may be exposed to offensive or inappropriate Content; use of the Services is at your own risk.

6. User Responsibilities and License

You retain ownership of the Content you submit, but by submitting it, you grant MandalaHeart a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, display, and distribute your Content to provide and improve the Services.

You are responsible for your use of the Services, for the Content you provide, and for interactions with other users. Any misuse of the platform, including impersonation, fraud, harassment, or illegal activity, is your sole responsibility.

7. Chat and Communication

Users may communicate with each other via chat messages on the platform. MandalaHeart is not responsible for any conversations or interactions between users, including disputes, misrepresentations, or agreements made off-platform. Users are responsible for their own behavior in chats and any consequences of moving conversations off-platform.

8. Fraud, Misrepresentation, and Legal Disclosure

Users may register accounts and post Content, but MandalaHeart is not responsible for fraudulent, misleading, or unauthorized use. If a user impersonates another person or acts without authorization, the user performing the action is solely responsible.

MandalaHeart may access, preserve, and disclose information, including account and Content, when reasonably necessary to:

Comply with applicable law or government requests
Enforce these Terms, including investigating violations
Detect, prevent, or address security, fraud, or technical issues
Respond to user support requests
Protect the rights, property, or safety of MandalaHeart, its users, or the public

9. Restrictions on Content and Use

You may not use the Services to:

Upload or transmit Content that is illegal, harassing, threatening, hateful, sexually explicit, or fraudulent
Misrepresent your identity or impersonate others
Access non-public areas of the Services or tamper with technical systems
Interfere with the Services or other users (e.g., spam, hacking, flooding)

MandalaHeart reserves the right, but is not obligated, to remove any Content, suspend or terminate users, and reclaim usernames without liability.

10. Account Deletion and Retention

Users may delete their accounts at any time. MandalaHeart may retain certain information temporarily due to technical, legal, or operational reasons even after account deletion. While we strive to remove all Content, some data may remain temporarily for operational purposes and will be removed as soon as reasonably possible.

11. Disclaimers and Limitation of Liability

The Services are provided “AS IS” and “AS AVAILABLE”. MandalaHeart makes no warranties regarding the completeness, accuracy, or availability of the Services. MandalaHeart is not liable for any damages, including direct, indirect, incidental, or consequential, arising from use of the Services or interactions with other users. MandalaHeart is not responsible for third-party links or content.

12. Termination

You may terminate your account at any time. MandalaHeart may suspend or terminate accounts for violations of the Terms, legal risk, or at its sole discretion. Sections on content, liability, account retention, and legal disclosure survive termination.

13. Governing Law

These Terms are governed by the laws of Nepal. Any disputes arising under these Terms shall be resolved under the jurisdiction of Nepalese courts.

14. General Terms

Waiver and Severability: Failure to enforce a provision does not waive MandalaHeart’s rights. If a provision is invalid, remaining provisions remain in force.

Entire Agreement: These Terms, together with the Privacy Policy, constitute the complete agreement between you and MandalaHeart regarding the Services. MandalaHeart may revise these Terms at any time; continued use of the Services constitutes acceptance of the revised Terms.

15. Data Security

MandalaHeart implements industry-standard security measures to protect user information, including profiles and chat messages. While no system is perfectly secure, we strive to maintain the confidentiality, integrity, and availability of your data.

In the rare event of unauthorized access, we may notify affected users and take prompt corrective action, including account security measures and investigation of the incident.

MandalaHeart may disclose information as required by law or to protect the rights and safety of MandalaHeart and its users. Our goal is to safeguard your data while providing a safe and reliable platform.

16. Offline Interactions

MandalaHeart only provides a platform for users to communicate and connect. We are not responsible for any interactions, agreements, or activities that occur offline, including meetings, financial transactions, or personal encounters. Users are solely responsible for their behavior and decisions outside the platform.

By using MandalaHeart, you acknowledge that any risks associated with offline interactions are your own, and you agree that MandalaHeart shall not be held liable for any harm, loss, or dispute arising from such offline activities.
